They avoid difficult conversations because no one wants to create tension before the business even begins.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I learned the hard way that this is the worst time to be casual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before money is invested, work begins, ownership is discussed, or responsibilities are divided, get your own attorney.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not the company\u2019s attorney.<br>Not your partner\u2019s attorney.<br>Not the person drafting the agreement for everyone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Your attorney.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Someone whose job is to protect you, explain the risks, challenge unclear language, and make sure the agreement says exactly what you believe it says.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important questions must be answered from the start:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who owns the company, brand, intellectual property, domains, phone numbers, customer data, and creative work?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Is money being invested, loaned, advanced, or exchanged for equity?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who controls the bank accounts, signs contracts, and makes final decisions?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What happens if someone leaves, stops performing, wants to sell, or remembers the agreement differently?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not leave these questions for later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Later is when the business has value. Later is when the money is significant. Later is when expectations have hardened and everyone has more to lose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A clear agreement does not damage trust. It protects it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And one review at the beginning is not enough. As the business grows, the documents should grow with it. New investments, roles, assets, partnerships, and responsibilities should be reviewed and documented along the way.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I learned this the hard way.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spend the money in the beginning. Hire qualified counsel. Ask the uncomfortable questions. Put the answers in writing.
